Dog Bite Laws in California

California’s dog bite laws strive to hold dog owners accountable when their pet harms someone. If a dog bites someone, the owner is generally held liable—often with the help of a dog bite law firm. Some states have what are colloquially referred to as “one bite” laws. In these states, owners are not held liable until after a dog is proven dangerous. Generally, a dog is not considered dangerous until it bites someone, which means that the first bite victim cannot seek compensation with a civil claim.

Luckily, California is not one of those states. Even if a dog has no history of being dangerous, owners are liable for harm caused to those who are lawfully on private property or on public property. This means that those who are trespassing generally cannot sue a dog owner, as their presence is unlawful.

When Can You Sue the Dog Owner?

Although the dog does not have to have a history of being dangerous for a dog bite claim to be successful, your attorney will still look for a range of conditions to be met. First, you must have been in a place you were legally allowed to be.

This includes public places like sidewalks and parks, but it also includes private places—including homes or stores—where you were legally present. Your
attorney may also ask if you provoked the dog. If a dog was protecting itself from harassment or provocation, the owner may not be held liable. This includes, for example, intentionally trying to scare a dog, getting in its face when it is clearly uncomfortable, and ignoring warning signs that the dog wants you to back off.

Challenges in Dog Bite Cases

It’s important to be aware of potential challenges you and your dog bite lawyer may face as you fight for fair compensation. You’ll need to prove how severe your injuries are, as there’s a good chance the owner will claim that the bite was minor or did not even break the skin. That’s why it’s important to seek medical care as soon as possible after a bite—it puts you one step closer to justice.

You may also run into roadblocks when it comes to insurance. Of course, insurance companies are a challenge in any type of personal injury claim. They downplay injuries, try to assign blame to the victim, and use victims’ words against them. But there are additional issues in dog bite claims. These claims are generally paid out through homeowners’ insurance policies. But if the owner did not let their homeowners’ insurance company know that they had a dog or they had a dog on the company’s “restricted breeds” list, the insurance company may claim that any compensation has to be paid by the homeowner—and if they don’t have the money, you may not get anything.

Compensation You May Receive

With a successful dog bite claim, you may be entitled to several forms of compensation. You may be compensated for your medical bills, including any invasive testing you had to go through. Your settlement may include money for lost wages if you were unable to work due to the bite, disability and disfigurement if the bite occurred in a visible place, and pain and suffering.
